First hire abroad

Hire the first person in a country you do not yet operate.

The first international employee is an operating design problem. Decide who the legal employer will be, whether the work is employment, and which records must exist before the first payday.

Before you pick a vendor

Write the working facts, then choose the employing route

A contractor template, a staffing agency, an employer of record, or your own registration can all appear on a shortlist. They are not interchangeable. The correct route follows the work, not the preferred invoice format.

Fact to recordWhy it changes the first hire
Work locationEmployment, tax, and social rules follow the place of work, not headquarters citizenship.
Direction and hoursIf your managers set schedule, tools, and method, many countries treat the role as employment.
Right to workAuthorization can sit with the worker, a sponsor, or a local employer. It is a feasibility gate, not an afterthought.
Compensation shapeSalary, allowances, variable pay, and equity each create different payroll and reporting inputs.
Start dateNotice from a current employer, background checks, payroll cutoff, and document collection all sit on the calendar.

A longer comparison of routes lives in How to hire abroad without a local entity.

When EOR is the usual path

Use an employer of record when the role is employment and you have no local entity

Farlinko becomes the local legal employer for the agreed role. Your company selects the person and directs day-to-day work. Local contracts, payroll, statutory contributions, and employment administration sit with the EOR under the service agreement.

First-hire questions

Questions to settle before the offer

Can we hire the first employee abroad without a local company?+
Often yes, if the role is employment and a qualified local employer can hire the person. Confirm the country, work location, authorization, and provider scope before promising a start date.
Is a contractor agreement enough for a first overseas hire?+
Only if the working facts match an independent-contractor relationship under local tests. A full-time, directed role is commonly employment even if the contract uses contractor language. See EOR vs independent contractor.
What do we need before the first payroll?+
Approved compensation, work location, start date, tax and social identifiers, bank details where required, benefits elections, and a signed local employment document. Missing inputs delay the cycle more often than the employment model itself.
