Hiring in South Africa: BCEA, PAYE reconciliation and UIF

South African employment administration combines Basic Conditions of Employment Act terms with SARS employer tax, UIF and related levies. Monthly EMP201 filings and EMP501 reconciliations are the payroll control, not year-end cleanup.

Employment system

What shapes a South Africa hiring plan

Labour termsApply BCEA and any sectoral determination
PAYEDeduct employees' tax and file EMP201
ReconciliationSubmit EMP501 with employee tax certificates
UIFContribute with PAYE subject to the published cap

These are planning inputs. Employee category, location, compensation, immigration status, collective terms and later rule changes can alter the required process.

Employment terms sit under the Department of Employment and Labour

The Department of Employment and Labour administers the Basic Conditions of Employment Act and inspects workplaces against labour legislation, including sectoral determinations and the national minimum wage where they apply.

Record hours, leave, notice and pay elements in the employment contract so they can be executed in payroll. Bargaining-council coverage, where it applies, is an additional source of terms.

PAYE is a monthly and reconciling employer process

SARS requires employers to deduct employees' tax and declare it on the monthly EMP201. Interim and annual EMP501 reconciliations must match payroll, payments and employee tax certificates. For 2026, SARS has published interim reconciliation dates and made valid income-tax reference numbers mandatory on employee certificates.

Issue IRP5/IT3(a) certificates from the same payroll result used in the reconciliation. Treat missing tax numbers as an onboarding blocker, not a later data-clean task.

UIF contributions travel with the EMP201

SARS collects Unemployment Insurance Fund contributions with employees' tax. Employer and employee each contribute, subject to a published monthly remuneration cap. Employees working fewer than 24 hours a month are among the listed exclusions.

Skills Development Levy and Compensation for Occupational Injuries and Diseases are related employer topics with their own thresholds or risk classes. Model them from current SARS and labour-department rules for the actual payroll, not from a single blended percentage.
